The U.S. Supreme Court is soon to decide whether to grant a certiorari petition in a regulatory takings case. If cert is granted, the court will have an opportunity to bring some order to the chaos in the present standards for takings. The case is Bridge Aina Le’a, LLC, v.. Hawaii Land Use Commission and arises out of a rezoning of a 1,060-acre lava field on the Big Island of Hawai’i.

There are indications the court might grant cert, which it does in only about 100-150 cases out of more than 7,000 petitions filed each year.
