The Connecticut Appellate Court—claiming plaintiffs counsel should have sought relief using the state defective highway statute as a remedy and not negligence—has reversed a jury award of $209,000 to a man injured when he struck a manhole cover on the road in New Haven.

The Connecticut Appellate Court’s 3-0 May 7 ruling is a signal to all attorneys who deal with municipal law and personal injury matters, experts said.
