Attorneys at Heidell, Pittoni, Murphy & Bach on Wednesday removed a medical malpractice lawsuit against Prestige Companion and Homemakers to Connecticut District Court. The suit was filed by attorney Paul S. Levin on behalf of Shainia Cintron, who alleges a relative at Prestige contracted and passed away from COVID-19 due to the negligence of caregivers. The case is 3:21-cv-00971, Cintron v. Prestige Companion and Homemakers.

In the June 21 complaint filed in Connecticut Superior Court in Waterbury, Cintron alleges Ruben Cintron contracted COVID-19 due to negligence on the part of the staff at Prestige in Southbury. Defendants responded with a motion to remove the case to federal court, citing broad immunity applicability of the Public Readiness and Emergency Preparedness (PREP) Act and the act’s express preemption of state law.
