Coupled with a judge’s granting class certification against restaurant chain Ruby Tuesday and what plaintiffs attorney Richard Hayber said is strong evidence the chain paid its servers less than it should have, the two sides agreed on a $1.2 million stipulation.

Hayber said he believes the plaintiffs and the defendant restaurant were able to tentatively settle the matter because the evidence, including a paper trail of hours the servers worked, against the chain, which is going through bankruptcy, was clear and evident.
