Hardly a week has gone by without a lawyer who filed an unfounded challenge to the 2020 Presidential election coming under scrutiny. Judges across the country have begun handing out sanctions in those cases. Bar disciplinary committees have been asked to sanction attorneys who played fast and loose with the profession’s ethical standards, both in court and in the public arena.

The legal profession’s proper roles involve balancing acts. There’s a danger that egregious misconduct can cause us to lose sight of one of the bar’s preeminent responsibilities—the duty to represent unpopular clients in unpopular causes.
