The nomination and Senate approval this past October of Sarah A.L. Merriam to be a U.S. District Judge for the District of Connecticut finally broke the senseless precedent that a U.S. Magistrate Judge, and before that, U.S. magistrates and commissioners, had never received an appointment as an Article III judge.

The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M.
