JUUL Labs sued EZ Mart Foods Thursday in Connecticut District Court over trademark infringement claims. The lawsuit, brought by McCormick, Paulding & Huber, accuses the defendant of selling counterfeit JUUL products. Lawyers have not yet appeared for the defendants. The case is 3:22-cv-00515, JUUL Labs, Inc.

Bringing the action under federal contract law, JUUL Labs alleges the defendants offered to sell and sold non-genuine JUUL products, also known as grey market goods, not in compliance with regulations of the U.S. Food and Drug Administration. Plaintiffs alleged a JUUL representative made an in-person purchase of the alleged grey market goods in November 2019, at an Exxon gas station business owned and operated by the defendant at 414 Cromwell Ave., Rocky Hill, and thereafter mailed cease-and-desist correspondence to the defendant.
