A federal judge in Connecticut has refused to dismiss an HVAC company’s claim against its insurer, saying it is too early to determine whether the insurer has a duty to defend its customer.

The case involves a general contractor, the PAC Group and The Saybrook at Haddam, an independent senior living center. The PAC Group entered into a contract with County Wide Mechanical Services to install an HVAC system for an expansion at The Saybrook. After installation of the system, there were a series of component failures and malfunctions which required a complete replacement of the unit.
