Finding that the trial court improperly concluded a defendant’s motion to open a judgment in favor of Mercedes-Benz Financial was untimely filed, a Connecticut Appeals Court majority has nonetheless affirmed the lower court’s decision in denying a motion to reopen.

In the underlying case, the defendants—Aniello Dizenzo and his company, 1188 Stratford Avenue LLC—entered into a motor vehicle lease agreement with a dealership in Fairfield for a 2013 Mercedes-Benz vehicle, according to the majority opinion that was officially released on Tuesday.
