Clarifying DUI Ambiguity, High Court Concludes Driver's License Suspension Was Limited to 45 Days, Reverses Appellate Court Ruling
"In sum, the suspension of a motor vehicle's operator's license pursuant to §14-227b(i)(1) does not continue until the operator has installed an IID but, rather, is strictly limited to the forty-five days specified in the statute," Senior Justice Christine E. Keller wrote on behalf of the unanimous court. "Because the defendant's license suspension period expired on Dec. 2, 2017, she was not operating a motor vehicle while her operator's license was under suspension on Dec. 4, 2017."

The Connecticut Supreme Court has reversed an appellate court judgment that a defendant's 45-day license suspension was extended until she installed an ignition-locking device on her vehicle.
Anastasia Schimanski was charged with operating a motor vehicle while under the influence in September 2017. Because she refused to take a chemical alcohol test, the Department of Motor Vehicles suspended her license for a 45-day period pursuant to General Statutes §14-227b(i)(1), starting Oct. 18, 2017, and ending Dec. 2, 2017, according to the high court's opinion filed Tuesday.
