Many advocates for people with disabilities were awaiting the decision from the U.S. Supreme Court in HHC v. Talevski with bated breath, fearing a ruling that would foreclose disabled people from enforcing their rights under the Federal Nursing Home Reform Act via a §1983 complaint. Thankfully, in a 7-2 decision, the respondents prevailed.

The Supreme Court upheld the 7th Circuit reversal of the district court decision granting a motion to dismiss. The Supreme Court ruling in favor of the family of the late Gorgi Talevski means that the litigation will continue and that people with disabilities and their advocates maintain a meaningful avenue to address violations of rights.
