"On the one hand, the psychiatrist-patient privilege's purpose is to safeguard confidential communications and records of a patient seeking diagnosis and treatment to protect the therapeutic relationship," Chief Justice Robinson wrote in his separate opinion. "On the other hand, the core legislative policy of FOIA is 'one that favors the open conduct of government and free public access to government records.'"

The Connecticut Supreme Court Justices were divided over what constitutes an exemption under the Freedom of Information Act.
The majority opinion concluded a police report about a patient's death, written by the police department at the Whiting Forensic Division of Connecticut Valley Hospital, which provides inpatient care to those in the criminal justice system with severe mental illness, must be disclosed under the Freedom of Information Act (FOIA).
