The first ruling on the merits in the lawsuit against Connecticut company CooperSurgical Inc., which alleged the company's defective culture media was the cause of mass embryo loss during the in vitro fertilization process for dozens of couples, went in favor of the plaintiffs.

Judge Mark A. Young of the Los Angeles Superior Court overruled the demurrer filed by CooperSurgical and The Cooper Companies, which claimed the plaintiffs' complaint was insufficient because the allegations "only provide[d] bare, redundant and formulaic allegations reciting the boilerplate elements of each cause of action."
