Marianne Varunes v. Janet Battey, et al.: A Hamden bookkeeper who broke her ankle in a fall at a restaurant lost her lawsuit after she was unable to prove there were problems with the establishment’s dance floor.
On a January night in 2005, Marianne Varunes planned an evening of dining and dancing at the Contrassegno Restaurant with friends. After the band set up and began playing, Varunes and her husband, Peter, had one dance. The other couple arrived. As Varunes left the dance floor to join them, she fell and broke her ankle and was taken to a hospital.
