Norwalk resident Claire Silva claimed her neighbor build a six foot high stockade fence to get back at her for opposing his plan to add a second story to his garage for rental income. After the planning board turned him down, Silva charged, Agron Djomblic built the fence to spite her.

The Silvas, represented by Norwalk attorney Martin M. Rutchik, claimed the “spite fence” was a private nuisance. A fence is a nuisance if it serves no purpose except to annoy a neighbor and impair the neighbor’s enjoyment of his or her property.
