Last month, defendant We Rent Minivans became an early beneficiary of a new federal law that abolishes vicarious liability for rental and leasing companies. In ruling in the company’s favor, Waterbury Superior Court Judge Robert C. Brunetti became just the third judge in the country to interpret 42 USC § 30106, the “rented or leased motor vehicle safety and responsibility” law.

Brunetti agreed with a Queens County., N.Y., court and a Maine federal court that the act’s Aug. 10, 2005, effective date prohibits any vicarious liability claim commenced after that, regardless of when the accident happened.
