The Connecticut legislature approved significant changes to the state’s Coastal Management Act and related laws which regulate certain activities in the state’s tidal, coastal or navigable waters following the devastating impacts from Tropical Storm Irene in 2011.
Public Act 12-101, “An Act Concerning the Coastal Management Act and Shoreline Flood and Erosion Control Structures,” makes notable amendments to the Coastal Management Act (Sections 22a-90 through 22a-112 of the Connecticut General Statutes ). Modifications include changing the basis for the Department of Energy and Environmental Protection jurisdiction from the “high tide line” to a newly created “coastal jurisdiction line” and recognition of private property owners’ rights in terms of coastal preservation policy. The majority of the new provisions are effective as of Oct. 1, 2012.
