Last week, I wrote about a recent seminar I participated in dealing with attorneys storing client files in the cloud. As promised, the panel attempted to offer some answers instead of scaring folks back to using clay tablets and papyrus scrolls. Here are some of the things we came up with.

As Pullman & Comley’s Marcy Stovall has noted, the authors of the ABA Ethics 20/20 amendments to the ethics rules apparently felt that rules are "insufficiently nimble" to keep ahead of technological changes and have punted to a "best practices" analysis without giving us any idea of what best practices are. While the ABA envisions establishing a resource where white papers, sample forms and such are made available, it is still a dream. We began discussing whether we can develop such a resource here, perhaps under the aegis of the Solo and Small Firms Section, and making this information available to all lawyers, perhaps on the Connecticut Bar Association website.
