Sometimes charging ahead with trial preparation in a contentious legal dispute is the surest way to resolve a case in the client’s best interest. That was the perspective of the litigation team at McCarter & English last year, when it picked a jury in a lawsuit over publishing rights for a number of Chicken Soup for the Soul books.
With about $15 million at stake, the dispute was waged between two publishers who claimed royalty rights for about 190 self-help books. The case had already undergone three years of intense litigation when the jury was sworn in.
