In law school, I tried to fulfill my upper class writing requirement by proposing a paper examining the brand new concept of lawyer advertising. Bates v. Arizona was decided the year I graduated. I thought this would be a great topic to explore. My supervising professor deemed that topic too "work a day." Instead, I wrote on Wittgenstein. In a funny karmic twist, I have spent the last 10 years of my career dealing with lawyer advertising. (I never had a case on Wittgenstein.)
The Ohio Supreme Court just issued an ethics opinion (2013-2) on lawyers' use of texting technology as lawyer advertising. Seems some lawyers buy police reports about accidents and these contain the phone numbers of the parties. Some enterprising lawyer have tried to text the injured victims for business.
