When someone gets roughed up by a bouncer at a nightclub on a Friday night, the first thing that goes through their mind is probably not that they might have a claim under the Connecticut Unfair Trade Practices Act.
But a lawyer for two men who claim were beaten by an employee of the now defunct Up Or On The Rocks in downtown Hartford back in 2011 convinced a judge recently that they have a CUTPA claim against the establishment, C&J Entertainment. As a result, if a jury returns a verdict in their favor in the pending negligence lawsuit, the plaintiffs can collect punitive damages against the nightclub.
