In her complaint filed Feb. 20, former Anthem customer Wilma J. Peterman alleges negligence, breach of contract, unjust enrichment, and violation of Connecticut’s Unfair Trade Practices Act. Although similar would-be class action suits related to the data breach have been filed in Alabama, California, Georgia and Indiana, Peterman’s claim is the first to be filed in Connecticut.
She asks U.S. District Judge Victor Bolden in New Haven to certify class action status. According to the lawsuit, an unknown number of affected Anthem customers have collective claims exceeding $5 million.
