A federal lawsuit has been filed against Wallingford-based Edible Arrangements, accusing the fancy fruit franchiser of violating the federal Telephone Consumer Protection Act by sending unwanted text messages to consumers over the course of four years.

Though the TCPA was enacted in the early 1990s to block waves of unwanted phone solicitations, it has since been expanded to include more modern forms of communication, including emails and text messaging. Unless the recipient of the message gives prior consent, for-profit companies are barred from using automated systems to send scores of messages, except in emergencies.
