Death row came calling again the other day. Not long ago, I accepted an appointment to handle a new trial petition for a man the state seeks to kill. Now the trial is set to begin. I have been given the gift of life.
Don’t mistake my meaning. The gift of which I speak is not the prospect of freedom for my client, or a stay of the order calling from his execution. Rolling life’s die is not life; playing God is the height of arrogance. Yet it is a game that our legislature lets prosecutors choose to play.
