A 15-year-old medical malpractice case against the University of Miami can proceed to trial after the Third District Court of Appeal decided Wednesday that it cannot claim immunity under Florida's Birth-Related Neurological Injury Compensation Act.

The ruling granted in part and denied in part the private university's appeal of decisions by a trial court and administrative law judge in the case of a Miami child who suffered brain damage during childbirth.

Judge Leslie Rothenberg wrote the opinion, and Judges Thomas Logue and Richard Suarez concurred.
