Holland & Knight is strenuously fighting a motion for sanctions in an online trademark infringement case that alleges the law firm and its client filed a frivolous lawsuit.

Holland & Knight partner Jeremy Ches and associated Ben Williamson of the Jacksonville office in a response filed late Tuesday claim the sanctions motion in their case was filed at the wrong time and is procedurally barred.

Additionally, they claim the motion offers a “straw-man argument” and noted it was filed the day before a major settlement conference “to intimidate an adversary into withdrawing contentions that are fairly debatable.”
