A state appellate court on Wednesday rejected Bank of America's bid to arbitrate a pair of $250 million lawsuits by 80 investors in disbarred attorney Scott Rothstein's Ponzi scheme.

The Fourth District Court of Appeal cleared the way for trial in Broward Circuit Court for the so-called Beverly and Kretschmar investors.

“The trial is on,” said Fort Lauderdale attorney William Scherer, who represents the investors. “We're looking forward to taking our first case against Scott Rothstein's Ponzi scheme to trial since all our others settled.”
