Miami attorneys for “Empire” creator Lee Daniels agreed to move his $10 million defamation battle with Sean Penn back to New York state court, paying Penn in the process.

Stroock & Stroock & Lavan partner James Sammataro and associate Jose Garcia-Tuñon told U.S. District Judge Edgardo Ramos on Tuesday that they agreed to move the case out of New York federal court.
