An appellate panel sided with a court-appointed guardian who refused to turn over a Miami-Dade parcel designated for student housing.

The Third District Court of Appeal Wednesday ruled in favor of the guardian of Redovaldo Foch, who was sued for failing to transfer the land under a memorandum of agreement executed in May 2013.

Foch contracted to transfer title of the Sweetwater parcel to Dayco Properties LLP, which in turn agreed to create a development company, secure construction financing for a 15-story building and obtain a payment and performance bond for the new company.
