A foreclosure attorney whose firm put a judge on hold twice after not attending two case management conferences will get a new hearing after a state appellate court reversed a criminal contempt order against him.

West Palm Beach lawyer Bruce Rosenwater is fighting an order fining him $500 and imposing a 10-day suspended jail sentence. He was defending a client in a foreclosure action by Deutsche Bank National Trust Co., but found himself in the hot seat for failing to appear at case management conferences before St. Lucie Circuit Judge William Roby.

Court records show Rosenwater was a no-show for a meeting scheduled after the bank amended its complaint and his client moved to dismiss the case. Roby denied the motion to dismiss and scheduled another conference. When Rosenwater did not attend that meeting, Roby called his firm, but was “initially met with some resistance from his office staff.”
