Pedicab Rider Blames Driver for Injuries After Pothole Stop
Key West and a pedicab company reach settlements after a passenger stepped into a pothole.

A woman who fractured her ankle stepping out of a pedicab received compensation from the pedicab company and the city of Key West.
In 2015, Pamela Berklich, 60, exited a pedicab on Simonton Street and stepped into a pothole. She fractured her right ankle, requiring surgery and hardware implants. She alleged Perfect Pedicab Inc. was negligent for allowing her to step in the hole. She also argued the city allowed a dangerous condition. Berklich settled with the city prior to trial.
The jury found the parties were each one-third liable. Berklich was awarded $269,000. The award was expected to be molded to reflect apportioned liability and the city's settlement, but Berklich and Perfect Pedicab reached an undisclosed settlement.
