BROWARD CIRCUIT COURT

A jury slapped a doctor with a $3 million damages verdict for a botched hernia surgery that left a patient partially disabled by nerve damage.

In 2005, Dr. Ian Concilio, a general surgeon, performed laparoscopic inguinal hernia surgery on Philip Serpico, 42. Afterward, Serpico had pain in his right leg. Concilio performed exploratory surgery and found that a tack, used as a fixation device, had damaged the femoral nerve. Serpico, who received spinal stimulator, said his nerve damage makes it hard for him to bend or to lift heavy objects. He was never cleared to return to his job as an electrician and now is part-owner of a bar, at a lower income.

Concilio denied negligence but then did not answer pleadings, and a default judgment was entered. The trial solely addressed damages.
