PREMISES LIABILITY

PINELLAS CIRCUIT COURT

A resident of a St. Petersburg condominium was awarded more than $7.5 million by a jury for injuries he suffered in a fall in a hot tub.

In 2008, Ehab Mina, 44, was about to enter the hot tub when he was startled to see it was partially drained, causing him to slip. He injured his right shoulder and spine, requiring multiple surgeries and forcing him to sell his boat-building business. Mina's counsel argued the hot tub should have had a warning about a lack of water and noted the area had poor lighting.

Defense counsel asserted the emptied hot tub was an obvious condition. The jury found Boca Ciega Resort & Marina Condominium Association Inc. and its management company, Condos by Sirata Inc., were equally liable. Mina received $7.56 million.
