SLIP AND FALL

BROWARD CIRCUIT COURT

A jury found a store was not to blame for a customer's fall.

On March 29, 2015, Kimberly Burnis, then 45, was shopping at a Ross Dress for Less store in Tamarac when she slipped and fell. She claimed the fall caused a torn meniscus and lumbar sprain. Burnis alleged a little girl was blowing bubbles near where she fell and Ross Dress for Less Inc. failed to timely clean up the soapy area or warn customers about the slippery condition.

Defense counsel claimed that while the girl may have been blowing bubbles nearby, numerous other people walked through the area without slipping or noticing any substance on the floor. Counsel also disputed the cause of the knee injury.
