SLIP AND FALL

BROWARD CIRCUIT COURT

A Broward County jury found Costco was not liable for a customer's injuries from a slip and fall in its store in Davie.

In 2013, Robin Singer, 57, was at the store when yogurt samples were being offered. She claimed she slipped on some spilled yogurt, resulting in injuries including two herniated spinal discs, tinnitus and hearing loss in her left ear, and a sacroiliac joint injury requiring fusion. She alleged the store was negligent in allowing the yogurt to remain on the floor, creating a dangerous condition, and then failed to warn customers.

Costco argued its staff lacked notice of the spill and there was no knowing how long it had been on the floor. The retailer also argued Singer was not attentive to where she was walking.
