MEDICAL MALPRACTICE

PALM BEACH CIRCUIT COURT

A nurse was found not liable for a patient's foot drop.

On the morning of April 13, 2014, Johnny Medeiros, then 42, found his right foot swollen and unable to move. A nurse at West Boca Medical Center attempted to contact Dr. Robert Jimenez, but he was at a conference. The covering surgeon, Dr. Mohammed Abdallah, said he would be in shortly but arrived in the early evening and surgically treated Medeiros' compartment syndrome later that night. Medeiros claimed the delay in treatment caused the foot drop. Jimenez and his practice were let out, and Abdallah settled. Medeiros claimed the nurse should have done more to ensure Abdallah saw him sooner.

The nurse claimed Medeiros' condition was not urgent and did not require immediate treatment.
