MOTOR VEHICLE

PALM BEACH CIRCUIT COURT

A jury found the driver of a sport utility vehicle was not to blame for a motorcyclist's neck injury.

On April 20, 2014, Abayomi Ogundipe was riding his motorcycle in West Palm Beach when he entered the far left turning lane. The SUV driven by Kelly Waffner entered the turning lane to his right. They vehicles collided as they made their turns. Ogundipe claimed Waffner crossed into his lane and broadsided his motorcycle, causing a herniated cervical disc that required a fusion.

Waffner claimed Ogundipe encroached into her lane while accelerating out of the turn and sideswiped her SUV. She also claimed any alleged injury was due to two prior collisions, in which Ogundipe also claimed neck injuries.
