MOTOR VEHICLE

PALM BEACH CIRCUIT COURT

A jury found a tractor-trailer driver was not liable another driver's claimed spinal injuries.

On Nov. 6, 2015, Maximino Perez Rivera, then in his 60s, was driving on Interstate 95 in West Palm Beach when his pickup truck was rear-ended by Christopher Lindquist's tractor-trailer. Rivera claimed the vehicles were driving in the same lane for miles before the impact. He claimed the crash caused a herniated cervical disc and an aggravation of a pre-existing lumbar condition.

Lindquist claimed Rivera pulled in front of him and then stopped, causing him to not have enough time to avoid hitting him. Defense counsel also presented surveillance video that appeared to show Rivera moving without pain.
