WAGE AND HOUR

U.S. DISTRICT COURT, FORT LAUDERDALE

A sales representative for a list and mailing service company received a $66,286 award after claiming his employer did not pay him proper overtime wages, sometimes did not pay minimum wage and did not pay him for his last week on the job.

Cornelius Caruso claimed Titan List and Mailing Services Inc. and owner Joan Piantadosi willfully violated the Fair Labor Standards Act by underpaying him.

The defense claimed Caruso did not work the overtime hours he claimed, disputed the accuracy of the company's internal reports and claimed Caruso's pay stubs accurately stated his work hours. The jury awarded Caruso damages for breach of contract, and the judge awarded additional liquidated damages.
