Following in the footsteps of the U.S. Court of Appeals for the Eleventh Circuit, a divided federal appeals court issued a broad decision rejecting a lawyer’s age-discrimination claim as a rejected in-house applicant.

The U.S. Court of Appeals for the Seventh Circuit, sitting en banc, upheld a trial judge’s ruling that said Illinois lawyer Dale Kleber could not bring “disparate impact liability” claims against the company that declined to hire him.
