MOTOR VEHICLE

MIAMI-DADE CIRCUIT COURT

A jury awarded $47,706 to a motorist who claimed spinal injuries following a rear-end collision.

On March 21, 2015, Erwin Apolo, then 46, was driving on Dixie Highway near Southwest 22nd Avenue in Miami when he was struck by Lucas Aloisi's vehicle. Apolo claimed herniated cervical and lumbar discs, which required a microdiscectomy. He also claimed his injuries affected his ability to work as an aviation welder and doctors recommended additional surgeries.

Defense counsel conceded liability but argued the impact was minor and could not have caused Apolo's injuires. Counsel also argued Apolo's lumbar injuries were from a prior crash. The jury award was solely for Apolo's past medical costs.
