BROWARD CIRCUIT COURT

The defense prevailed after two homeowners alleged breach of contract against their insurance company, which refused to cover the cost of floor damage and repairs.

Carolyn Blue, then 59, and her daughter, Ashley Skipper, then 33, alleged many of the ceramic tiles in their floor ended up cracked due to water damage that stemmed from a leak in the bathroom.

Counsel for Citizens Property Insurance Corp. successfully argued the tile damage resulted from improper installation and long-term water exposure before the insurance policy took effect. The defense also contended the plaintiffs made similar damage claims under previous homeowner insurance policies.
