JOB DISCRIMINATION

US DISTRICT COURT, MIAMI

The U.S. Equal Employment Opportunity Commission settled with two Miami-based sheet- metal fabrication and installation companies after the federal agency alleged the companies fired a worker who lost an eye but was medically cleared to resume work.

The EEOC alleged the termination violated the Americans with Disabilities Act. The companies denied liability, contending the injured worker was not an employee at the time of termination, but they ultimately agreed to a settlement to avoid a trial. The companies agreed to pay $30,000, adopt and distribute a comprehensive ADA policy, and schedule yearly management and employee training on the ADA.
