PREMISES LIABILITY

MIAMI-DADE CIRCUIT COURT

A tenant who was shot outside his Opa-locka apartment complex reached a $1 million settlement in a negligent-security lawsuit against the property owner.

Tywaun Jones suffered multiple gunshot wounds on Sept. 1, 2016. He claimed the shooting resulted from him confronting a drug dealer who was selling narcotics on the property. Jones' attorney claimed at least 10 drug arrests had been made at the complex in the previous three years, suggesting the landlord should have improved security.

The landlord contended the property was well-protected relative to crime in the neighborhood, but it ultimately agreed to a settlement to avoid a trial.
