PREMISES LIABILITY

MIAMI-DADE CIRCUIT COURT

A jury ruled a factory worker was entitled to over $500,000 in damages after she slipped on melted ice cream at a Hialeah supermarket.

Mirta Baluja, 48, was shopping at a Presidente Supermarket owned and operated by Tropical Supermarket No 12 Inc. As she walked near a cart with unpurchased items left near cashiers, Baluja slipped and fell, injuring her arm, shoulder, elbow and wrist. Her attorney presented a surveillance video showing ice cream had been left in the cart for at least a half hour, melted and dripped on the floor.

The jury determined the supermarket was 100 percent liable and found Baljuia’s damages totaled $502,000.
