Mychelle Tice, a retail store manager in her 30s, was stopped at University Drive at Griffin Road when her car was rear ended by Deborah Elwell on June 24, 2013. Tice claimed she suffered back, neck and shoulder injuries.

Elwell claimed Tice's vehicle was not stopped at the light but ran out of gas, and another car blocked her view of Tice's vehicle until it was too late to notice. The defense presented a medical record indicating Tice told a doctors about another vehicle and complained of similar symptoms after a January 2013 collision. The jury sided with the defense, which represented  21st Century Centennial Insurance Co.
