MEDICAL MALPRACTICE

SEMINOLE CIRCUIT COURT

A jury ruled for a family doctor who was sued by a patient who alleged an untreated neurological condition led to permanent foot injuries.

In April 2012, Christopher Albarado, then 30, sought treatment for a back injury. His family doctor prescribed painkillers, rest and physical therapy. Albarado skipped the physical therapy and later developed paralysis of his legs and feet, though his legs have recovered.

He claimed he should have been referred to a neurosurgeon, but the defense argued there were no indications for such a referral and conservative treatment was the correct plan since Albarado's condition was not worsening and didn't keep him from working. The jury sided with the defense.
