MOTOR VEHICLE

VOLUSIA CIRCUIT COURT

A man claiming a brain injury following a motor vehicle accident agreed to settle his claims for a total of $168,000.

Joshua MacLeod was driving on U.S. 1 in Port Orange when Carl Mercendetti made a left turn in front of MacLeod's sport utility vehicle, which overturned. MacLeod sued Mercendetti and the underinsured motorist carrier, State Farm, alleging Mercendetti failed to yield and his liability policy was insufficient to cover his losses.

MacLeod, who claimed hearing and memory loss due to the collision, settled with State Farm for $18,000 and later settled with the liability carrier for an additional $150,000.
