PROFESSIONAL NEGLIGENCE

ORANGE CIRCUIT COURT

A jury awarded nearly $5 million to a woman who inadvertently overdosed after receiving a mail-order pharmacy prescription that was 10 times stronger than her prescribed dosage.

The woman was prescribed testosterone cypionate to correct a hormonal imbalance. She claimed the overdose changed her voice, led to the appearance of unwanted body hair and caused a vaginal deformity.

The defense conceded the error in the prescription but contended the woman's physical changes may have been caused by other medication the woman was using. The jury disagreed, and it awarded damages of $4.96 million.
