PREMISES LIABILITY

MIAMI-DADE CIRCUIT COURT

A jury awarded more than $93,000 to a woman who claimed she injured her back and neck in a fall while shopping in a Hialeah WalMart store.

Marizol Castillo blamed her fall on water that had been spilled in a store aisle. She claimed she suffered herniations of her C5-6, C6-7 and L4-5 intervertebral discs, and she required spinal fusion.

Wal-Mart contended that Castillo fell because she was rushing and inattentive. The jury assigned 65 percent of the blame to Castillo, reducing the $266,100 award to $93,135.
